NFCore (the "Application") is provided by Echo Persona LLC ("Company," "we," "us," or "our") on an "AS IS" and "AS AVAILABLE" basis, without any warranties or representations of any kind, whether express, implied, statutory, or otherwise.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We make no warranty that the Application will meet your requirements, operate without interruption, be error-free, secure, or that any defects will be corrected. Your use of the Application is at your sole risk.

NFC (Near Field Communication) technology involves reading from and writing data to electronic tags. This process carries inherent risks that you must understand and accept before using this Application.

You acknowledge that you are solely responsible for any and all consequences resulting from your use of the Application, including but not limited to data loss, tag damage, device damage, and any associated costs or losses.

Echo Persona LLC is NOT RESPONSIBLE for any data loss, data corruption, or data modification that occurs as a result of using NFCore, including but not limited to:

• Loss of data stored on NFC tags during read, write, clone, or modification operations
• Corruption of tag memory due to interrupted write operations, power loss, or signal interference
• Accidental overwriting of important data stored on NFC tags
• Loss of data in the Application's local storage due to app updates, reinstallation, or device changes
• Corruption of data exports, backups, or transferred information
• Loss of data due to memory dump operations or raw command execution
• Any data loss resulting from user error, misunderstanding of features, or misuse of the Application

YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING BACKUPS OF ALL IMPORTANT DATA. WE STRONGLY RECOMMEND BACKING UP TAG DATA BEFORE PERFORMING ANY WRITE OR MODIFICATION OPERATIONS.

Echo Persona LLC is NOT RESPONSIBLE for any damage to NFC tags resulting from use of the Application, including but not limited to:

• Permanent locking of NFC tags (intentional or accidental)
• Bricking of NFC tags due to failed write operations
• Corruption of tag firmware or internal memory structures
• Damage caused by memory dump operations or raw hex editing
• Damage caused by sending raw NFC protocol commands
• Physical damage to tags during scanning attempts
• Any damage to access cards, key cards, transit cards, payment cards, or other NFC-enabled credentials
• Damage to hotel room keys, office access badges, parking garage cards, or similar access control media
• Damage to any third-party NFC tags, regardless of value or importance

The Tag Lock feature, once applied, is PERMANENT AND IRREVERSIBLE. We are not responsible for tags that are accidentally or intentionally locked using this feature.

Echo Persona LLC is NOT RESPONSIBLE for any damage to your device or other hardware, including but not limited to:

• Damage to your iPhone's NFC reader or antenna
• Battery drain or overheating caused by extended NFC operations
• Software crashes, system instability, or operating system issues
• Interference with other device functions or applications
• Damage to other electronic devices in proximity during NFC operations
• Any hardware malfunctions that occur during or after using the Application

You are SOLELY RESPONSIBLE for ensuring that your use of NFCore complies with all applicable local, state, national, and international laws and regulations. This includes, but is not limited to:

• Laws regarding unauthorized access to computer systems and electronic devices
• Laws regarding duplication or cloning of access credentials, identification cards, or payment instruments
• Laws regarding interference with security systems or access control mechanisms
• Laws regarding identity theft, fraud, and forgery
• Laws regarding privacy and data protection
• Contractual obligations and terms of service for third-party NFC systems
• Employer policies regarding access credentials and security badges
• Building and property access regulations

Prohibited Activities

You agree that you will NOT use NFCore to:

• Clone, duplicate, or copy any NFC tag, card, or credential without explicit authorization from the owner
• Bypass, circumvent, or defeat any security system, access control, or authentication mechanism
• Gain unauthorized access to buildings, rooms, vehicles, or restricted areas
• Create counterfeit access credentials, identification cards, or payment instruments
• Interfere with public transportation, toll collection, or payment systems
• Commit identity theft, fraud, or any other illegal act
• Violate the privacy or property rights of any individual or organization
• Engage in any activity that could cause harm to persons or property

ECHO PERSONA LLC DISCLAIMS ALL LIABILITY FOR ANY ILLEGAL, UNAUTHORIZED, OR IMPROPER USE OF THIS APPLICATION. YOU ASSUME FULL LEGAL RESPONSIBILITY FOR YOUR ACTIONS.

While NFCore stores all data locally on your device and does not transmit data to external servers, we make NO GUARANTEES regarding the security of your data. You acknowledge that:

• Data stored in the Application may be accessible to other applications or processes on your device
• Device backups (including iCloud backups) may contain Application data
• Physical access to your device may allow others to access Application data
• NFC tag data, including cloned credentials, may be read by third parties with appropriate equipment
• The Application does not provide encryption or additional security for stored data beyond what iOS provides
• We are not responsible for any security breaches, unauthorized access, or data exposure

You are solely responsible for maintaining the security of your device and any sensitive data stored in or created by the Application.

The Emergency Info feature allows you to store medical and emergency contact information on NFC tags. You acknowledge and agree that:

• This feature is provided for CONVENIENCE ONLY and should not be relied upon as a primary source of emergency or medical information
• We do not guarantee that emergency responders, medical personnel, or any other individuals will be able to read, access, or understand information stored on NFC tags
• Many emergency responders do not carry NFC readers or may not be trained to look for NFC-based medical information
• NFC tags may fail, become damaged, or be unreadable in emergency situations
• Information stored on NFC tags may become outdated if not regularly updated
• Medical decisions should NEVER be made solely on the basis of information retrieved from NFC tags
• This feature does not replace proper medical alert bracelets, medical ID cards, or official medical documentation
• We are not responsible for any adverse medical outcomes, delayed treatment, or harm resulting from use of or reliance on this feature

ALWAYS CARRY PROPER MEDICAL IDENTIFICATION AND INFORM MEDICAL PROFESSIONALS OF YOUR CONDITIONS DIRECTLY.

NFCore includes advanced features intended for experienced users with technical knowledge of NFC technology. These features include, but are not limited to:

• Memory Dump: Reading and editing raw memory pages in hexadecimal and ASCII formats
• Command Console: Sending raw NFC protocol commands directly to NFC tags
• Tag Inspector: Protocol-level inspection of NFC tag structures and properties
• Tag Lock: Permanently write-protecting NFC tags

THESE FEATURES ARE EXTREMELY POWERFUL AND CAN CAUSE PERMANENT, IRREVERSIBLE DAMAGE TO NFC TAGS IF USED INCORRECTLY.

By using these advanced features, you represent and warrant that:

• You have sufficient technical knowledge to understand the consequences of your actions
• You accept full responsibility for any damage caused by using these features
• You will not use these features on tags you do not own or have explicit authorization to modify
• You understand that incorrect commands can permanently destroy tags

We provide no documentation, support, or guidance for recovering from errors made while using advanced features. Use at your own risk.

NFCore is designed to work with a variety of NFC tags and protocols. However, we make NO GUARANTEES regarding compatibility with any specific:

• NFC tag types, manufacturers, or models
• Access control systems or security platforms
• Payment systems or financial services
• Transit systems or transportation networks
• IoT devices or smart home systems
• Any other third-party NFC-enabled systems or devices

We have no affiliation with any NFC tag manufacturers, access control vendors, or other third parties. Compatibility may vary and may change without notice due to third-party system updates or modifications.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ECHO PERSONA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages arising from data loss, corruption, or unauthorized access
• Damages arising from tag damage, destruction, or malfunction
• Damages arising from device damage or hardware malfunction
• Damages arising from security breaches or unauthorized access to stored data
• Damages arising from illegal or unauthorized use of the application
• Damages arising from reliance on the emergency info feature
• Damages arising from use of advanced features
• Damages arising from third-party claims or legal proceedings
• Any other damages arising out of or related to your use of the application

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Echo Persona LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Application
• Your violation of this Disclaimer or the Terms of Service
• Your violation of any applicable law or regulation
• Your violation of any third-party rights
• Any claims made by third parties arising from your use of the Application
• Any damage caused by your use of the Application to NFC tags, devices, systems, or property

We reserve the right to modify this Disclaimer at any time without prior notice. Changes will be effective immediately upon posting to this page. Your continued use of the Application after any changes constitutes your acceptance of the modified Disclaimer.
